Liability Waiver and Release Form
This Liability Waiver and Release (“Agreement”) is entered into by and between Lolo’s Party Rentals (“Company”) and the undersigned customer (“Customer”).
By renting equipment from Lolo’s Party Rentals, which may include but is not limited to inflatable bounce houses, slides, water slides, balloon decorations, tables, chairs, and related party equipment (“Equipment”), I acknowledge and agree as follows:
1. Assumption of Risk
I understand that the use of the Equipment involves inherent risks, including but not limited to physical injury, falls, collisions, drowning, suffocation, electrical hazards, property damage, or even death. I voluntarily assume all risks associated with the rental, use, and participation in activities involving the Equipment.
2. Supervision & Safety Obligations
- I am solely responsible for supervising all participants, including children, at all times.
- I will ensure that all safety rules and instructions provided by Lolo’s Party Rentals are followed.
- I will not allow use of the Equipment in unsafe conditions, including bad weather, extreme heat, or improper surfaces.
- I will provide adequate space and access for safe setup and removal.
3. Release of Liability
To the fullest extent permitted by law, I release, waive, and discharge Lolo’s Party Rentals, its owners, employees, contractors, and affiliates from any and all liability, claims, demands, or causes of action for injury, property damage, or death that may occur in connection with the Equipment.
4. Indemnification
I agree to indemnify and hold harmless Lolo’s Party Rentals from any claims, actions, damages, or expenses (including attorneys’ fees) arising from my supervision, use, or misuse of the Equipment.
5. Responsibility for Equipment
I am financially responsible for any lost, stolen, or damaged Equipment during my rental period, normal wear and tear excepted.
6. Governing Law
This Agreement is governed by the laws of the State of Nevada. Any disputes will be resolved in the courts of Clark County, Nevada.
7. Severability
If any part of this Agreement is found unenforceable, the rest will remain in effect.
